Personal data is data that can be used to identify a natural person. Therefore, all data that allow conclusions to be drawn about you is personal, e.g. your name in connection with an address, many, but by no means all, e-mail addresses. Personal data also includes data that only enables a person to be identified in combination with other data, often from another data processor, e.g. your IP address in combination with a time at which you were online. THURN & BAUER and its subsidiaries process your data, for example, when you submit a specific inquiry about a property presented on our website or about our services as a property developer, property management company, real estate agent or through our customer service departments, or when you contact us in any other way.

We always process data such as your IP address and browser or app IDs for technical operation and further development when you use the offers of the THURN & BAUER network.

We only use the personal data you provide insofar as they are necessary to fulfill the respective purpose; e.g.

  • when registering for one of our online offers that require registration

information desk

You have the right to request information from us about how we use which of your data. You can request a copy of your data processed by us. Exercising your right to information must not impair the rights of other people.

Rectification

You have the right to request that your data be corrected. If, despite our efforts to ensure that the data is correct and up-to-date, incorrect information is stored, we will correct it at your request.

deletion

You have the right to request the deletion of your data, provided that it is not processed on a legal basis that opposes the deletion. If the legal requirements for deletion are met, we will carry out the desired deletion immediately.

Restriction

You have the right to request the restriction of processing for the same reasons as with a right to erasure. In this case, the data must remain stored (e.g. to preserve evidence), but may no longer be used for any other purpose.

Data portability

You have the right to receive the data that you have made available to us in a commonly used machine-readable format if the processing is based on your consent or the performance of a contract.

Contradiction

You have the right to object to data processing that is based on a legitimate interest. In this case, we are legally obliged to weigh your interests against our own. If the result is a predominance of our interests, we will reject the objection with justification. Otherwise we will stop the corresponding data processing immediately.

If you are of the opinion that we have violated Austrian data protection law when processing your data and have thereby violated your rights, we ask you to contact us in order to be able to clarify any questions. You have contacted us in writing by letter or e-mail or have given us a business card. You will now find out how and for what purpose we process your personal data when you contact us. We also inform you about your rights as a data subject. The protection of your personal data is very important to us.

Sending free documents

If you would like to receive information material from us, your data will be processed to fulfill your request. If it is necessary to send it by post, we will transmit your data to the respective delivery service provider. In order to be able to answer any queries you may have, your data will be stored three months after the materials have been sent. We therefore ask for your understanding that, should you contact us again at a later point in time, we will no longer be able to provide you with any information as the data will no longer be stored in our system.

Inquiries by email, letter or using the contact form

If you would like to receive information from us about certain offers or services of the company, we will process your data to process your request. We will delete your personal data within the framework of your inquiry, suggestion or complaint after one year at the latest. We therefore ask for your understanding that if you have a query at a later point in time, we will no longer be able to provide you with any information about the content of your request, as your data will no longer be stored in our system.

Storage of the contact details of business partners and, if necessary, their contact person

If you do business with us, we will save and process your contact details and, if applicable, the contact details of a contact person. We use this data on the basis of a legitimate interest in initiating business, submitting or receiving offers, concluding contracts, maintaining business relationships such as invitations to events without a marketing background (such as summer parties, Christmas parties, company anniversaries).

We will store your data for as long as the business relationship exists. If you get in contact with us via a contact person, we will store the contact details of these persons for as long as they remain our contact person. In order to be able to guarantee that the data is up-to-date, we ask you to inform us actively about any changes in this situation.

If agreements result from this business relationship, this data is processed in accordance with civil, tax and corporate law provisions.

In order to protect our legitimate interest, namely us against the failure of a supplier, your data can be transmitted to a rating agency.

Your data - both of the business partner and the respective contact person - will be transmitted to the following offices:

  • Responsible administrative authorities, in particular the tax office

  • Federal agency “Statistics Austria” for the compilation of the legally required (official) statistics

  • Chartered accountant

  • Legal representation, debt collection agencies and courts, insofar as this is necessary for legal defense or legal enforcement

We will store your data for as long as statutory retention periods, such as tax law or company law, provide for this.

Procurement processes

In the context of solicitation of offers or tenders, we process the data you provide to correctly carry out the procedure in order to ultimately be able to determine the most economical offer. In these procedures, we are sometimes supported by external companies (e.g. legal representatives, experts, consulting companies) to whom we have to transmit the data in order to provide these services. In order to protect our legitimate interest, namely us against the failure of a supplier, your data can be transmitted to a rating agency. In any case, the data will be stored for three years after the end of the procedure. In addition, the data is stored for the later traceability of the profitability, whereby the data of those companies that did not receive the order are only stored insofar as they are necessary for traceability. The data will be kept by the company receiving the order for the duration of the contract. In addition, storage is only carried out to the extent that statutory retention requirements (in particular in accordance with tax and company law regulations) prescribe this.

Your rights

In principle, you have the right to information, correction, deletion, restriction, data portability and objection.

If you believe that the processing of your data violates data protection law or that your data protection claims have been violated in any other way, you can complain to the data protection authority.
